What is NEC?

NEC is a condition caused by cow milk-based formulas. Premature babies have difficulty processing the cow’s milk formula which leads to inflamed gastrointestinal tissue, and other issues like holes in the intestines that make infection possible. NEC poses serious injury to infants and can be fatal.

What are known symptoms of NEC?

The exact cause of NEC is unknown although its connection to cow milk-based baby formulas has been documented since 1990. NEC was found to be 10 times more common in premature babies who had been given baby formula. Some symptoms of NEC include:

  • Low weight, no weight gain
  • Intestinal stricture
  • Short bowel (short gut) syndrome
  • Development delays
  • Abdominal pain and swelling
  • Heart rate changes
  • Body temperature increases

What are the long-term side effects of NEC?

Premature infants who are diagnosed with NEC may experience neurodevelopmental delays, gastrointestinal problems such as strictures and adhesions, short bowel syndrome, cholestasis, intestinal failure and more. Two out of every ten babies die as a result of NEC.

What is the NEC baby formula lawsuit all about?

Baby formula manufacturers Abbott Laboratories (Similac) and Mead Johnson & Company  (Enfamil) have known the dangers of their products for more than 30 years, but continued aggressively marketing them as safe for consumption and “better” than breast milk. Formula companies were negligent. Now parents and caregivers whose children suffer from NEC are seeking justice and filing lawsuits.

Think you may have an NEC baby formula lawsuit?

Can I expect an NEC settlement?

If you have a child who was born prematurely and became ill with NEC after being fed Similac or Enfamil baby formula then you may be able to file an NEC lawsuit. NEC settlements are to compensate for the pain, suffering, loss, and medical expenses associated with your loved one being diagnosed with the condition.

How to know if you have a legal NEC case

If your child was born premature and has been diagnosed with NEC after a recorded history of Similac or Enfamil consumption, then you may be eligible to file an NEC settlement suit. Current lawsuits have alleged that the baby formula was defectively designed when cow’s milk was included. Others assert that baby formula manufacturers should have properly warned the public of the dangers of their product.
